GENERAL DEFINITIONS
  • WORKING DAY – any day other than Saturday and Sunday or legal holiday on witch legal business can be conducted according to Polish jurisdiction.
  • REGISTRATION FORM – Internet shop form that allows creating an account.
  • ORDER FORM – Internet shop electronic service that allows making product orders, especially by adding them to virtual cart and specifying conditions of shipment and payment.
  • ORDER – declaration of will told by the Service recipient through the order form to buy a product via the Internet shop and making this way a transaction agreement with the Service provider.
  • CLIENT – a natural person, a legal person or any other person without corporate status.
  • CIVIL CODE – polish bill: Civil code from 23th April 1964 (Dz.U. 1964 nr 16, poz. 93 ze zm.).
  • NEWSLETTER – electronic distribution service managed by the Internet shop administrator using e-mail, witch allows the service users to automatically receive periodic information about new products, bargains and news of the Internet shop.
  • PRODUCT – the item available for sale in the Internet shop.
  • INTERNET SHOP – the Internet shop under the address http://www.tomaszhanc.com.
  • PRIVACY POLICY – is a statement or a legal document (in privacy law) that discloses some or all of the ways a party gathers, uses, discloses, and manages a customer or client’s data.
  • TERMS AND REGULATIONS – the present terms of use of the Internet shop.
  • THE SELLER, THE SERVICE PROVIDER: Tomasz Hanć, Stocznia Grafiki Sp. J. located under the address: ul. Bobrowa 19, 70-791 Szczecin, Poland, NIP 955-239-07-88, KRS 0000606393.
  • ELECTRONIC SERVICE – the service provided on the Internet via Internet shop by the service provider to the service recipient.
  • SERVICE RECIPIENT – a natural person, a legal person or any other person without corporate status willing to use the electronic service.
  • CONSUMER RIGHTS BILL – the Polish consumer rights bill from 30th may 2014 (Dz.U.2014 poz. 827).
  • ORDER FORM – the order form begins with selecting the product size and frame color and then adding the product to cart in the Internet shop. The Internet shop calculates the price accordingly to chosen parameters.
  • CURRENCY CHANGER – prices of products are showed either in PLN or EURO and can be changed by the currency changer visible on the product pages of the Internet shop. The Client declares in which of the currencies he wants the selling agreement to be made.

PRIVACY POLICY

WHAT DO WE COLLECT?

Every time the Client visit our site our web server automatically collects the following non-personally identifiable information: the Client internet service provider’s address, the referring URL and information on the pages the Client access on our site. We collect this information to help diagnose problems, administer our website and track usage statistics. All of this information is collected and used only in the aggregate; that is entered into our database where we can use it to generate overall reports on our visitors, but not individual reports that identify the Client personally.

We also collect personally identifiable information that the Client provide, such as information the Client provide when the Client register on the site, for example, the Client name, the Client email address, the Client telephone number, the Client postal address, and any other preference information that the Client provide to us. The Client may look on our site without disclosing any personally identifiable information.
By using the site, the Client are consenting to have the Client personal data transferred and processed in Poland by the service provider.
WHAT ARE “COOKIES”?
Most Internet sites collect data about visitors through the use of “cookies”. Cookies are small software programs that help sites recognize repeat visitors by assigning a random number to each desktop for tracking content preferences and traffic patterns. Cookies may be used to “connect” the Client computer to information stored in a separate location. The site may use browser cookies to track user behavior. Through cookies we may also: alert the Client to new issues that we think might be of interest to the Client when the Client return to the site; record past activity at the site in order to provide the Client better service when the Client return to the site; or, customize web page content based on the Client browser type or other information that the Client send us.
We do not use cookies to store any of the Client personal information on the Client computer. The “help” portion of the toolbar on most browsers will tell the Client how to prevent the Client browser from accepting new cookies, how to have the browser notify the Client when the Client are to receive a new cookie, or how to disable cookies altogether.
HOW DO WE USE THE CLIENT INFORMATION?
We use the information we collect to improve our communications, improve our content and offerings, analyze site usage, troubleshoot problems, resolve disputes, and enforce our Terms of Use.
Additionally, the information we collect is used:
1) To generally improve the content of the site,
2) to improve the content of the site for individual visitors,
3) to notify the Client about updates to the site,
4) for internal review.
When the Client supply us with personal information in the course of creating an account, the information the Client provide will be added to our customer database. The Client will receive periodic news from us. If the Client does not want to receive such communications from us, then please delete the Client account.
We may send the Client e-mail with information on new services. If the Client do not wish to receive such e-mail in the future, please contact us at contact@tomaszhanc.com to remove the Client self from our e-mail list.
SHARING THE CLIENT INFORMATION WITH THIRD PARTIES
We contract with third-party service providers in order to operate our business, including operating the site.  Those service providers may need access to the Client information to perform fulfillment and other services. We undertake to provide only that portion of the Client information needed to perform the pertinent service, and we require that all of our service providers hold the Client information in confidence and use it only to provide the service for which they have been engaged.
We do not provide contact information to third party marketers without the Client permission. We share the Client information with third parties only in limited circumstances where we believe such sharing is:
1) Reasonably necessary to offer the service,
2) Legally required or,
3) Permitted by the Client.
The information is not provided to these companies for marketing purposes.
LINKS
The Site may contain links to other websites. We are not responsible for the privacy practices of other web sites. We encourage our users to be aware when they leave the Site to read the privacy statements of each and every web site that collects personally identifiable information. This privacy policy applies solely to information collected by us.
HOW DOES THE CLIENT KNOW THE CLIENTR INFORMATION IS SECURE?
We have appropriate security measures in place in our facilities to protect against the loss, misuse or alteration of information that we have collected from the Client at the site so the Client can feel comfortable and secure. However, we cannot guarantee the protection of information against interception, misappropriation, misuse, or alteration or that the Client information may not be disclosed or accessed by accidental circumstances or by the unauthorized acts of others.
Please note that e-mail is not encrypted and is not considered a secure means of transmitting credit card numbers.
CHILDREN UNDER THE AGE OF 18
We will not knowingly collect personally identifiable information from any person under the age of 18.  Our services are not designed to attract the attention of persons under the age of 18.
PUBLIC FORUM
The site allows users to share information, is open to the public and should not be considered private. The Client should think carefully before posting any personally identifiable information in any public forum. What the Client post can be seen, disclosed to or collected by third parties and may be used by others in ways we cannot control or predict, including to contact the Client for unauthorized purposes. If the Client mistakenly post personal information in our community areas and would like it removed, the Client can send us an email to request that we remove it. In some cases, we may not be able to remove the Client personal information and if we can’t, we will let the Client know and why not.
CHANGES TO THIS PRIVACY POLICY STATEMENT
From time to time, we may use the information the Client provide us for new, unanticipated uses not previously addressed in our privacy policy. If our information practices change at some time in the future we will post the policy changes on the Terms of Use or privacy page of the site to notify the Client of these changes. We encourage the Client to check the site periodically for more information on how we use the data we collect. If there is a material change in the manner we use data we collect, we will update this privacy policy to reflect these changes.

If the Client feel that this the site is not following its stated information privacy policy, the Client may contact us at the above address or phone number or email address.
CHANGE IN POLICY
We reserve the right to revise, amend, change or update this privacy policy at any time, so please review it frequently.  For significant changes to this policy, we may, but are not obligated to notify the Client either by placing a prominent notice on the home page of our site or by sending the Client a notification.  We encourage the Client to review this policy periodically to stay informed about our use of the information we collect.  We will indicate near the top of this page the date this policy was last revised.  The Clientr continued use of the site after we have revised this policy constitutes the Clientr agreement to the revised version.
TERMS & CONDITIONS
This website for Tomasz Hanć Photography (the “Website”) is owned and operated by Stocznia Grafiki Sp.j., ul. Bobrowa 19, 70-791 Szczecin, Poland, NIP 955-239-07-88, registered under KRS 0000606393, referred to herein as “SG”, “we”, “us”, or “our”. By using the Website and/or its mobile applications (the “site”) the Client agree to the following Terms of Use, which constitute an agreement between the Client and the service provider with respect to the use of the site and the purchase of any products or services from or through the site.  We may change these terms from time to time.  The Client will always be able to view the most current version by clicking on a link at the bottom of any page on the site.
CURRENT AND ACCURATE INFORMATION
The Client represent and warrant the accuracy and completeness of all information the Client provide to us.  The Client agrees to promptly notify us of any change in the information the Client have provided to us.
CONSENT TO RECEIVE COMMUNICATIONS
The Client acknowledge and agree that we may send written and electronic communications to the Client in connection with the site, the Client use of the site, and any products or services obtained or that the Client will obtain by or through the Site.  The Client expressly consent to the receipt of any all notices from us by way of email including correspondence we are legally obligated to provide the Client.
PRIVACY AND PERSONAL INFORMATION
In connection with the Client use of the site we may collect, obtain and maintain personal information about the Client in accordance with our privacy policy.  The purpose of our privacy policy is to identify the information we may collect about the Client, describe the uses we may make of the Client information and the security measures we take to protect it, and describe the Client options for controlling the Client information. The Client can review our privacy policy for the service below.
ACCOUNT, PASSWORD, AND SECURITY
If the Site requires or provides the Client with the option to open an account, the Client must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. In the event that the Client must choose a password and username, the Client is solely responsible for maintaining the confidentiality of the Client password and account information. Furthermore, the Client is solely responsible for any and all activities that occur under the Client account. The Client agrees to notify us immediately of any unauthorized use of the Client account or any other breach of security. We will not be liable for any loss that the Client may incur as a result of someone else using the Client password or account, either with or without the Client knowledge.
PAYMENT INFORMATION AND PROCESSING
The Client is required to provide all information necessary to use the site and to complete any order.  Payment of the Client order will be processed upon submission of the Client order through the site and the Client authorize us to share the Client information as is necessary to process the payments.  We may refuse or cancel any order for any reason (including, but not limited to, pricing errors) without any liability, and in event of any such cancellation the Client sole recourse and remedy shall be the return of all amounts paid by the Client for such order. Settling of accounts through electronic transactions and payment cards by Przelewy24 – the currently available payments methods are available on website “http://www.przelewy24.pl.
The payments by electronic transactions and payment cards are made by the Clients choice and through the service Przelewy24.pl. The payment service is provided by PayPro SA, ul. Kanclerska 15, 60-327 Poznań, NIP: 779-236-98-87, registered under KRS 0000347935.
Settling of accounts through electronic transactions and payment cards by PayPal – the currently available payments methods are available on website “http://www.paypal.com.
The payments by electronic transactions and payment cards are made by the Clients choice and through the service PayPal.com. The payment service is provided by PayPal (Europe) S.à r.l. & Cie, S.C.A., L-1150 in Luxemburg.
SHIPPING
The shipping is available on the territory of Poland and selected European and world countries.
If the agreement does not include different statesmen’s the shipping cost are treated as additional fees. The shipping cost are calculated and showed to the Client on the Internet store while the Client is making order.
The shipment is made by domestic and international shipping of Poczta Polska.
The shipping time on the territory of Poland takes up to 7 working days. The international shipping time depends of Poczta Polska S.A. services.
SALE AND RETURN POLICIES
Credit card payment is the only form of payment accepted through the Website. Any order the Client place through the site is considered to be a binding offer by the Client to purchase the items ordered through the site, and the Client offer becomes a binding agreement upon SG accepting the Client order on the site.  The Client agree that the Client order may be subject to applicable taxes which are in addition to the sale price of the Client order.  The Client shall be responsible for all applicable taxes on the Client order.
SG reserves the right to change prices, terms, specifications and warranties for products on the site at any time without prior notice. While SG will attempt to ensure that pricing and other product information is accurate, errors may sometimes occur. When any errors in product specifications, descriptions, and pricing are discovered by SG, SG reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions, including after an order has been submitted. If an error in pricing is discovered after the Client order has been submitted, SG will inform the Client of the error at which time the Client may cancel or reaffirm the Client order at the Client option.
SG will promptly attempt to fulfill each order submitted through the site.  Nonetheless, if an order is not capable to being fulfilled, SG will promptly contact the Client.
The purchase price for the Client order is due upon placing the order and we will charge the credit card account the Client identified when the Client order was placed, plus the cost of shipping, handling and applicable taxes.

All sales are final, non-refundable and non-returnable.  For instructions on what to do in the event the Client receive the wrong print in error, or a damaged product, contact the seller via e-mail: contact@tomaszhanc.com.

 

THE RIGHT TO WITHDRAW FROM THE AGREEMENT
  1. A Client who concludes a distance agreement can withdraw from this agreement within 14 days without giving any reason thereof and without incurring any costs, except the costs specified in points 7 and 8 below. A notice on the right of withdrawal from the agreement, including in particular, information on the method and deadline for performing the right to withdraw from the agreement, and on the costs borne by the Client when returning the products in the event of a withdrawal, constitutes Appendix 1 to these Terms and Conditions.
  2. The lapse of the period for withdrawing from the agreement starts at:
    1) For a sale agreement – from the Client, or a third party appointed by the Client other than the courier, taking possession of the product and, for an agreement including many products delivered separately, in batches or in parts – from acquiring the ownership of the last product, batch or part;2) For other agreements – from the date of concluding the agreement.
  3. A Client can withdraw from the agreement by informing the service provider of the decision to withdraw by an explicit statement, for instance, by sending the letter by post to the address: Stocznia Grafiki Sp. J. Tomasz Hanć, ul. Bobrowa 19, Szczecin 70-791, Poland, marked “Return”, or by sending a statement by email to the email address: contact@tomaszhanc.com. A statement of withdrawal can be submitted on the withdrawal form attached as Appendix 2 to these Terms and Conditions, but using the form is not obligatory.
  4. [Applicable only under Swedish jurisdiction] A Client can also submit a statement of withdrawal on the model form issued by the Swedish Consumer Agency, which can be retrieved at www.konsumentverket.se.
  5. To keep the deadline for withdrawing from the agreement, it is sufficient to send the information on performing the right to withdraw before the lapse of the deadline.
  6. In the event of withdrawing from the agreement, a Client is obliged to return the product to the service provider immediately, and no later than within 14 days from the date of informing the service provider about withdrawing from the agreement. To keep the deadline, it is sufficient to send the product before the lapse of the 14-day period to the address: Stocznia Grafiki Sp. J. Tomasz Hanć, ul. Bobrowa 19, Szczecin 70-791 Poland.
  7. The Client is obliged to bear direct costs of returning the product.
  8. If the Client choses a method of delivering the product other than the cheapest standard delivery method offered by the service provider, the service provider is not obliged to reimburse the additional costs borne by the Client.
  9. In the event of withdrawing from the agreement, the Serivce Provider will, immediately but no later than within 14 days from the date of receiving the Client’s statement of withdrawal, return all the payments received from the Client including the cost of delivery, except the additional costs of the delivery method other than the cheapest delivery method offered by the Service Provider chosen by the Consumer.
  10. The payment will be returned by the Service Provider with the same payment method that the Client used, unless the Client explicitly consents to another payment method – in any case the Client will not bear any costs due to this return.
  11. the Service Provider may suspend the return of the payments received from the Client until the receipt of the products, or confirmation of posting the products from the Client, whichever comes first.
  12. The Client is liable for a decrease in the value of the product resulting from using the product in a way other than necessary to determine the nature, qualities and functioning of the product.
  13. The Client does not have the right to withdraw from a distance agreement with respect to the following agreements:
    1) agreements on performing services, if the entity performed the service with the explicit consent of the consumer who was informed prior to the service provision that after performing the service by the entity the Client will lose the right to withdraw from the agreement;2) agreements that concern a customized product that is not prefabricated, but produced according to the Client’s instructions, or aimed at fulfilling their individual demands;4) agreements concerning products delivered in sealed packaging that cannot be returned after opening the package due to health protection or hygiene, if the packaging was opened after the delivery;

    5) agreements concerning products that, due to their nature, are to be permanently combined with other products after the delivery.

COMPLAINTS PROCEDURE 

  1. The Service Provider is obliged to deliver goods to Clients without the physical or legal defects pursuant to the statutory provisions.
  2. Complaints may be submitted by Customers in writing to Service Provider at:

  3. Complaints should include in particular: full name, postal address, email address if the Customer wishes to receive a response to the complaint via email, the date of purchase of the product, the type of product being complained about, an accurate description of the defect and the date of noticing it, the Customer’s demand, as well as the Customer’s preferred way of hearing the decision concerning the complaint. Along with the submitting the complaint, proof of purchase of the product must also be given to the Service pRovider. This may be, for example, a copy of the receipt, a copy of an invoice, a payment record or any other proof. Please note that providing the abovementioned data by the Client is recommended though not obligatory. Therefore the Client may submit a complaint excluding that data which would not affect its effectiveness.
  4. The Service Provider will consider and address complaints immediately, not later than 14 days from the date of submitting the complaint. The Client will be informed of the method of handling the complaint in the manner requested when submitting the complaint.
  5. Complaints about the newsletter or other electronic services, including irregularities in the operation of the Online Shop, can be submitted:
    1) directly by email to the address: contact@tomaszhanc.com
  6. Complaints concerning the newsletter or other electronic services should include in particular: a description of the matters covered by the complaint, the email address provided when registering a Client Account or placing an order, and the email address or postal address to which the Client wants the response to the complaint to be sent, if different, as well as the Client preferred way of hearing the decision concerning the complaint. Please note that providing the abovementioned data by the Client is recommended though not obligatory. Therefore the Client may submit a complaint excluding that data which would not affect its effectiveness. The complaint will be considered and an answer will be sent within 14 days from the date of the Service Provider receiving the complaint. The Client will hear about the decision in the manner indicated when submitting the complaint.
  7. If anything is missing from a submitted complaint, The Service PRovider will inform the Client using the address indicated on the complaint.
FORCE MAJEURE
SG shall be excused from performance under these Terms of Use due to a state of force majeure, the laws or regulations of any government, regulatory or judicial authority, war, civil commotion, destruction of facilities and materials, fire, flood, earthquake, storm (or other act of God), labor disturbances, shortage of material, failure of public utilities or common carriers, and any other causes beyond the reasonable control SG, and any non-performance or delay in performance due to the aforementioned shall not constitute a breach of these Terms of Use.
TERMINATION
In the event that the Client use of the Site is terminated for any reason, we will not refund any payments that the Client has previously made for goods or services that were previously shipped.
MODIFICATION; SEVERABILITY
We may modify the site, these Terms of Use and our policies at any time in our sole discretion. Therefore, the Client should review our policies, Terms of Use each time the Client visit the site. The Client continued use of the website after we make any such changes constitutes the Client binding acceptance of those changes. If any of the Terms of Use herein shall be deemed invalid, void, or for any reason unenforceable, that term or condition shall be deemed severed and deleted to the extent required and shall not affect the validity and enforceability of any remaining term or condition.
If any invalid, unenforceable or illegal provision of the Terms of Use would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.
ENTIRE AGREEMENT
These Terms of Use constitute the entire agreement and understanding between the Client and SG with respect to the site and the Client use of the site.  In the event of a conflict between these Terms of Use the Polish civil code rules shall apply.

The service provider is the administrator of personal data used for carrying out the general provisions of this terms and regulations. The personal data is administrated according to rules described in the Privacy Policy included in this terms and regulations.
If the Client does not wish to be bound to these Terms and conditions, please do not use this site.

Appendix No 1

NOTICE ON THE RIGHT OF WITHDRAWAL
The right of withdrawal from the agreement
You have the right to withdraw from this agreement within 14 days without giving any reason.
The deadline for withdrawing from the agreement expires after 14 days from the day on which:
1) you, or a third party indicated by you, other than the courier, take possession of the product – in the case of an agreement involving the transfer of ownership of the product,
2) you, or a third party indicated by you, other than the courier, take possession of the last of the products – in the case of an agreement involving the transfer of ownership of many products that are supplied separately,
3) you, or a third party indicated by you, other than the courier, take possession of the last of a batch or a part thereof – in the case of an agreement involving the transfer of ownership of batches or parts thereof,
4) the agreement is concluded – in the case of service agreements.
In order to exercise your right of withdrawal, please let us, i.e.

You can use the sample form of withdrawal from the agreement, though this is not obligatory.
In order to keep the deadline for withdrawal, it is sufficient to send your information on exercising the right of withdrawal from the agreement before the deadline for withdrawal.
Effects of withdrawing from the agreement
If you withdraw from this agreement we will reimburse all payments received from you, including the delivery costs (with the exception of additional costs if you chose a delivery other than the least expensive normal delivery offered). The payments will be reimbursed immediately, and in any event no later than 14 days from the day on which we are informed about your decision to exercise the right to withdraw from this agreement.
Reimbursement will be made using the same payment method that you used for the initial transaction, unless you have expressly consented to a different solution. In any case, you will not incur any fees in connection with the reimbursement.
We may withhold reimbursement until we have received the returned products, or have received evidence of their return, depending on which event occurs first.
Please send or handover the product immediately, and in any event no later than 14 days from the day on which you inform us of your withdrawal from this agreement.
The deadline is met if you send back the item before the 14-day deadline to:

You will have to bear the direct cost of returning the products.
